Boomerang Evolution makes consumers aware of all the essential characteristics of the items offered. These characteristics may relate to the dimensions, quantities, of the goods offered.

Article 3: Availability of goods

The items offered by Boomerang Evolution are available while stocks last.

Article 4: Photographs

The photographs used on our site are only indicative. Boomerang Evolution does not guarantee the colors presented.

Article 5: Client commitment

The customer agrees to complete the order form and provide all the information necessary for his identification. He must also ensure that the information is accurate and complete. The fact of validating the order form constitutes the validation of the order and will be worth irrevocable acceptance of these general conditions of sale. This acceptance can only be called into question in certain limited cases provided for in this contract under Article 10: "right of withdrawal" The information given by the buyer when placing the order is binding on the latter. In the event of an error in the wording of the recipient's contact details, the seller can not be held responsible for the impossibility in which it may be to deliver the product. In the event of delivery outside the territory of the European Union, the consumer agrees to check the import possibilities of the products ordered with regard to the country of delivery.

Article 6: Order confirmation and contract conclusion

After validation of payment, the order is considered accepted by Boomerang Evolution. Boomerang Evolution will then confirm acceptance of the order to the customer by email. This confirmation can serve as proof in the event of a dispute. Boomerang Evolution reserves the right to cancel the order if it is not able to fulfill it and will notify the customer by email. This confirmation, or where applicable, the refusal to accept an order, will thus be confirmed to the user no later than 72 hours after receipt of the order. The account is debited simultaneously with the acceptance of the order by the merchant.

Article 7: Price

The prices of the products presented in a shop are valid at the time of their consultation by the customer. The prices invoiced are those in effect at the time the order is placed. The prices are printed in euros. The prices on our site are net prices. The transport will be added automatically and will be visible on the order form. In the event of delivery outside the territory of the European Union, customs taxes and related formalities are the sole responsibility of the consumer.

Article 8: payment

Payment for orders can be made by check, bank transfer or credit card (cb, visa, eurocard, mastercard).

When the customer chooses to pay by credit card, his credit card number and date of validity are communicated in encrypted mode (SSL) to our bank (CIC) which will be the sole custodian of this information. The order does not become effective until payment has been confirmed. The data relating to the bank card are only kept during the order processing time.

When you pay by credit card, you are invited at the end of the order to tell us your card number and the validity date. Various accesses to authorization servers are then carried out in order to verify the data to prevent abuse and fraud. For this, the server is in encrypted mode and all the information conveyed is encoded. Nothing goes unencrypted on the web.

Article 9: delivery

Boomerang Evolution undertakes to deliver the products ordered within 30 days from the date of the order. Boomerang Evolution delivers worldwide: Colissimo or green letter depending on the size of the order (for France and Northern Europe) and postal services (for the rest of the world). Delivery is made to the address indicated by the customer when ordering. Delivery can only take place if the buyer is up to date with his obligations to the seller if the good is unavailable, the consumer will be informed as soon as possible and may cancel his order. His bank account will then not be debited. Any complaint should be addressed to the address indicated in article 1 (email or postal address). The consumer will check the general appearance of the packaging of the delivered product. In the event of damage or non-compliance, he undertakes to report it in writing on the delivery slip. He will notify Boomerang Evolutions by email or fax within 3 days. In the event that the reservations made on the delivery slip reflect the non-conformity of the goods delivered, Boomerang Evolution undertakes to exchange the product. We are in no way responsible for any delays in delivery on the part of the carrier (post).

Article 10: Right of withdrawal

In accordance with the legislation on distance selling, the consumer has a withdrawal period of 7 working days, from receipt of the product with regard to the goods. Exercising the right of withdrawal requires the merchant to reimburse the sums paid by the buyer free of charge as soon as possible and at the latest within 30 days. The only costs which can be charged to the consumer by reason of the exercise of his right of withdrawal are the direct costs of returning the goods.

Article 11: Proof

Order confirmations will be archived at Boomerang Evolution and will be considered as proof of the nature of the agreement and the date.

Article 12: Transfer of risks

The transfer of risks on the products takes place as soon as the products are handed over by Boomerang Evolution to the carrier. Thus the products travel at the risk and peril of the customer.

Article 13: Retention of title

In all cases, the delivered goods remain the property of Boomerang Evolution until their complete payment (law n ° 80-335 of May 12, 1980).

Article 14: Right of access to files

For the smooth running of the order, the personal data collected will be subject to computer processing, the consumer acknowledges having knowledge of it. In accordance with article 34 of the Data Protection Act of January 6, 1978, the consumer may exercise the right of access to information concerning him recorded in the files of Boomerang Evolution and have them corrected if necessary.

Article 15: Applicable law and competent courts

These conditions of sale are governed by French law. In the event of a dispute relating to the sale of products and the execution and interpretation of these conditions of sale, only the courts of Nantes are competent.

We do our best to offer you the decorations visible on the site, however, having dealt with many suppliers the decoration changes constantly and it is possible that sometimes the decoration varies according to the arrivals independently of our will, therefore the decoration is not contractual it can vary, only the boomerang itself is guaranteed.
